Overview

These Terms of Service (the "Terms") govern your access to and use of Blackvault websites, apps, VPN service, software, documentation, and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.

"Company", "we", "us", or "our" refers to BLACKVAULT TECHNOLOGIES SRL. "You" or "your" refers to the person using the Services.

Eligibility

You must be at least 13 years old (or 16 in the EEA/UK) to use the Services and have the legal capacity to enter a contract in your jurisdiction. If you use the Services on behalf of an entity, you represent that you have authority to bind that entity and these Terms apply to it.

Account & Communications

To use certain features you may need an account. You agree to provide accurate information, keep your credentials confidential, and notify us of unauthorized use. You consent to service-related communications (e.g., security notices). You can opt out of marketing emails via the provided links.

License & Acceptable Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal use. You will not:

  • Resell, sublicense, share, or otherwise provide the VPN to others (including account sharing beyond your household) without our permission.
  • Copy, modify, distribute, or make derivative works of the Services except as expressly allowed.
  • Reverse engineer or attempt to extract source code except where permitted by law.
  • Bypass or interfere with security, access controls, rate limits, or network management.
  • Use automated means to access the Services in a manner that overloads or disrupts them.
  • Use the Services for unlawful, harmful, or abusive activity, including but not limited to: distributing malware; phishing; DDoS; illegal content distribution; copyright or trademark infringement; harassment; child sexual abuse material; or activities violating sanctions/export laws.
  • Use the Services in prohibited or embargoed countries or by sanctioned persons/entities.
  • Use the Services for emergency or life-support purposes. The VPN does not support emergency calling.

We may implement reasonable technical measures (e.g., concurrent connection limits, bandwidth management, or network abuse prevention) to protect the Service and users.

Service Description

  • We support WireGuard and OpenVPN. Keys are rotated on each connection. Servers use disk encryption for sensitive data at rest.
  • We operate a strict privacy-first approach; see our Privacy Policy for details on what we do not log and minimal telemetry.
  • Performance, speeds, and availability may vary by region, network conditions, and device. Some networks or services may block VPN traffic.

Paid Plans, Billing & Stripe

  • Consumer payments are processed by Stripe. We do not store full card numbers. Taxes may apply.
  • Subscriptions auto-renew until canceled. You can cancel at any time; access continues until the end of the current billing period.
  • We may change prices or plan features with notice for future billing cycles.
  • Refunds: where required by law or at our discretion. EU/UK consumers: you have a 14-day right of withdrawal for online purchases; however, for digital services that begin immediately upon your request, you acknowledge that the right of withdrawal may be lost once full performance starts.

Third-Party Services

The Services may rely on or link to third-party products and services (e.g., hosting, analytics, payments, app stores). Their terms and privacy policies apply to your use of those services.

User Content

You retain ownership of your inputs and other content you submit ("User Content"). You grant us a worldwide, royalty‑free, non‑exclusive, sublicensable license to use, host, reproduce, modify, and display User Content solely to provide and improve the Services, comply with law, and create de‑identified, aggregated insights.

You represent that you have all necessary rights in your User Content and that it does not violate law or third‑party rights.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR‑FREE OPERATION OR THAT THE VPN WILL BYPASS ALL GEO‑RESTRICTIONS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) USD 100 OR (B) THE AMOUNTS YOU PAID TO US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

Consumer mandatory rights may provide additional protections; in such cases, these limitations apply to the maximum extent permitted by law.

Indemnification

You will defend, indemnify, and hold harmless the Company and its affiliates, officers, employees, and agents from any claims and expenses arising from your use of the Services, your User Content, or your violation of these Terms or law.

Governing Law & Dispute Resolution

These Terms are governed by the laws of Romania, without regard to conflict‑of‑laws rules. For consumers, mandatory local consumer protection laws may also apply. Courts of Bucharest, Romania, shall have non‑exclusive jurisdiction.

Note: Arbitration clauses for consumers may be restricted in certain jurisdictions; consult your counsel if you plan to add arbitration.

Termination

We may suspend or terminate your access if you breach these Terms or misuse the Services. You may stop using the Services at any time. Upon termination, your license ends. Provisions that by nature survive (e.g., ownership, disclaimers, limitations, indemnities, governing law) will continue to apply.

Changes to the Services or Terms

We may modify or discontinue features at any time. We may modify these Terms; material changes will be notified via the Services or email and by updating the date above. If you continue using the Services after changes take effect, you accept the revised Terms.
